The terms governing use of the KinectAI platform. We aim to keep them short, fair and readable.

These Terms of Service ("Terms") govern your access to and use of the KinectAI website (kinecttalent.com), the KinectAI web application and all related services (together, the "Service"), operated by KinectAI ("KinectAI", "we", "us"). By creating an account or otherwise using the Service you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
1. The Service
KinectAI provides an AI-powered Talent Operating System covering recruitment CRM, applicant tracking, AI chat and voice interviews, WhatsApp recruitment automation, a talent marketplace, an AI resume builder, workforce intelligence, training, readiness assessments, coaching and certifications. Specific features available to you depend on your account type and subscription.
2. Accounts
You must provide accurate registration information and keep it current. You are responsible for all activity under your account and for safeguarding your credentials. Notify us immediately at security@kinecttalent.com if you suspect unauthorized access.
3. Acceptable use
- Do not use the Service to violate any law or third-party right.
- Do not upload malware, scrape at scale, or attempt to bypass security, rate limits or tenant isolation.
- Do not impersonate any person, misrepresent qualifications, or submit fraudulent applications.
- Do not use the Service to send unsolicited bulk messages or to harvest contacts.
- Do not use AI outputs to make fully automated decisions with legal or significant effects on candidates without a human in the loop.
4. Customer data and content
You retain ownership of the data you upload ("Customer Data"). You grant KinectAI a worldwide, non-exclusive license to host, process and transmit Customer Data solely to provide and improve the Service. Employer tenants are responsible for the lawfulness of candidate data they upload and for honoring data subject requests.
5. AI features
The Service includes AI-generated outputs (e.g. scoring, interview summaries, recommendations). AI outputs are probabilistic, may contain errors and must be reviewed by a qualified human before any consequential decision. You are responsible for decisions you make using AI outputs.
6. Third-party integrations
The Service integrates with third-party providers including Google (Calendar, OAuth), WhatsApp, email delivery and AI model providers. Your use of those services is governed by their respective terms. KinectAI is not responsible for third-party services or their availability. You may disconnect any integration at any time from Settings.
7. Fees and subscriptions
Paid plans are billed in advance on the cadence shown at checkout. Fees are non-refundable except where required by law. We may change pricing on notice; changes apply from the next renewal.
8. Confidentiality
Each party will protect the other's confidential information with the same care it uses for its own, and no less than reasonable care. This obligation survives termination.
9. Intellectual property
KinectAI and its licensors own all rights in the Service, including the platform, branding and underlying technology. No rights are granted to you except as expressly set out in these Terms.
10. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, suspected fraud, non-payment, or risk to the Service or other users. You may terminate at any time by closing your account. On termination, your right to use the Service ends; we will delete Customer Data per our retention policy.
11. Warranties and disclaimer
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Each party's aggregate liability arising out of or relating to these Terms will not exceed the amounts paid by you to KinectAI for the Service in the twelve months preceding the claim.
13. Indemnity
You will indemnify KinectAI against third-party claims arising from your Customer Data, your use of the Service in breach of these Terms, or your violation of law.
14. Governing law
These Terms are governed by the laws of South Africa, without regard to conflict-of-laws rules. The courts of Johannesburg have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence.
15. Changes
We may update these Terms from time to time. Material changes will be notified via the platform or by email. Continued use after an update constitutes acceptance.
